Use of this service constitutes agreement to abide by the rules and regulations of the system, as promulgated by the webmaster from time to time, including acceptance of the following terms and conditions.

The construction reporting service contains information about plans, bidders and other matters that may be of interest to members of the Builders Exchange and/or customers of Syrabex, Inc. Information reported in the project files is based on a review of the specifications, no plans have been reviewed. Syrabex offers no warranty, express or implied, that any of the reported information is accurate or complete. The best source of information for project files are the actual plans and specifications maintained at Syrabex or at the offices of the drafting Architect or Engineer. The user understands that the service does not represent that all documents for every project are in the information displayed by the service, nor that the documents accessed through this service are accurate or complete.

Syrabex expressly disclaims and user hereby waives all warranties, including the warranties of merchantability and fitness for a particular purpose, in connection with the use or operation of the construction reporting service, or the plans and specifications available to the users of this service.

Syrabex or the Builders Exchange will not be liable for any losses, including lost data, information, profits or any direct, incidental or consequential damages that may be sustained or arise out of the use, operation or ability to use or operate the construction reporting service. In consideration for the privilege of using the construction reporting service, users hereby release Syrabex and Syracuse Builders Exchange, its officers, employees, affiliates, and the webmaster from any and all claims arising from the use of this system/service. Users understand and agree that the plans and specifications made available are for informational purposes and as stated herein user assumes all risk.

The information on the Construction Reporting Service is provided for the use of Builders Exchange members and Syrabex customers only, replication is prohibited. Members are encouraged to review the plans and specifications maintained at the Builders Exchange to insure all relevant documents are reviewed by the member.

The Builders Exchange reserves the right to limit access to the construction reporting service. Access may be denied at any time for any reason. Access will be denied to any individual or company who makes use of the construction reporting service for improper purposes. Access will be denied to anyone who uses obscene, abrasive or otherwise questionable language on this system. Such denial is at the sole discretion of Syrabex.

Syrabex reserves the right to monitor all information stored in any files, programs or messages as well as the right to delete or edit any file, program or message that contains, in the sole discretion of Syrabex, any obscene, abrasive or otherwise objectionable language or material.

The United States Copyright laws prohibit the distribution or copying of copyright materials without proper authorization. Syrabex will not tolerate any use of the construction reporting service which in any way violates the United States Copyright laws. Users must report to Syrabex any use of the construction reporting service which may amount to a copyright infringement. If in its sole discretion, Syrabex determines that any information has been loaded onto the construction reporting service in violation of the Copyright laws, Syrabex will delete that information. Any user who, without authorization violates or is charged with violating the law, or who loads copyrighted information on the construction reporting service shall indemnify and hold the Syracuse Builders Exchange and Syrabex harmless from any and all resulting claims and liability, including attorneys’ fees.

User agrees that its user name(s) and password(s) are for user’s use only and user will not make them available to others for any purposes. Should the user fail to comply with this agreement, Syrabex may terminate the user’s name and password and access without refund.

In the event that Syrabex, its officers, its agents, affiliates, webmaster or others should be named as a defendant or party in action or proceeding which arises out of or relates to any actions by the user, the user agrees to indemnify, defend and hold harmless Syracuse Builders Exchange and Syrabex, its officers, its agents, employees, affiliates, webmaster or others from any and all harm, liability and damages.
